Conditional Waiver on Progress Payment
The safe waiver to sign when submitting a pay application. Only becomes effective when payment clears. Download the California statutory form.
Use this waiver when you are submitting a pay application and have not yet received payment. It waives your lien rights for the billing period covered, but only becomes effective once the payment actually clears your bank.
When to use
Submit this with every progress pay application. It is the safe option — if the check bounces or payment never comes, the waiver is void and your lien rights are preserved.
